The weekly fee applies to the weekly regular working hours of 40 hours agreed in the general contract for film and television professionals under TZ 5.2. 


II. 1 Scope:

1.1. 
For the territory of the Federal Republic of Germany.

1.2. 
Matter on fact: For non-publicly organized companies producing films. 1.2.1. This collective wage agreement does not obtain advertising films.

1.3. 
Personal: For all Film and TV professionals – like stated in the collective agreement -who are working directly in a context of a film or TV production.
These are, in particular, activities in the trades: directing, production, equipment / set design, camera, performing artists (actors, singers, dancers), image editing / film editor, sound, post-processing / VFX, lighting / camera set, Make-up, costume design, special effects, stunt as well as assistants of the aforementioned sectors and filmmakers in similar or other activities directly related to the production of films. 

1.3.1. 
This does not obtain film and television professionals who are exclusively engaged in dubbing.

  • work on sundays and public holidays
  • calculation of the surcharges for overtime and night work
  • travel time payment
  • calculation of working days started
  • remuneration for overtime 
  • claims for short-term cancellation in regards of working days requiring daily wages
  • vacation wages

statutory minimum wage


The statutory minimum wage amounts since January 1, 2020  has been EUR 9.35 is gross per hour. The statutory minimum wage obtains also the film industry in case there are no higher wages of a collective agreements.

The statutory minimum wage obtains: 
  • all employees, regardless of working time or extent of employment over 18 years
  • foreign employees working in Germany - regardless of whether they are employed by a domestic or foreign employer. (Territorial principle)
  • for cross-border activities for employees employed in Germany

The statutory minimum wage does NOT obtain:
  • apprentices according to the Vocational Training Act
  • volunteers
  • people taking a voluntary service serve
  • participants in a job promotion measure
  • homeworkers according to the homework act
  • self-employees
  • young people under the age of 18 without completed vocational training
  • long-term unemployees within the first six months after re-entering the labor market

Generally, in regards of surcharge the law ArbeitszeitG states: 

There is no surcharge for overtime and work on sunday but for work at nighttime (between 11 pm and 6 am, §2 ArbeitszeitG). A minimum surcharge of 25% per hour must be paid or a corresponding time off must be granted.
