the general rule:


The specific exemptions to be obtained under road traffic law depend on the scope of the filming and the impact on general road traffic.

Filming that is only carried out with a handheld or shoulder camera and does not affect public traffic, including pedestrians and cyclists, and does not use any superstructures, does not require a license from the road traffic authorities, only an approval for special use. (see: filming in small teams) This regulation applies equally to filming in Berlin and Brandenburg.  


Filming where either:

  • several actors participate
  • objects are placed on public street land 
  • traffic signs or facilities for parking or play areas may be required

are subject to approval - in Berlin and Brandenburg.

regulations for Berlin


The following permits are required for major filming on public streets in Berlin:  

  1. General filming permit as a basic requirement for the road traffic regulation by the central film office of the Senate Department for Environment, Traffic and Climate Protection, Dept. VI A - Traffic Management, Central Road Traffic Authority (formerly VLB)
  2. Road traffic regulation of  the central film office of the Senate Department for the Environment, Transport and Climate Protection, Dept. VI A - Traffic Management, Central Road Traffic Authority (formerly VLB)
  3. Special use permit from the district's civil engineering department responsible for the respective location

Please note:
When filming in a public green area like parks or playgrounds, a permit from the nature conservancy and parks department of the responsible district is also required. 

When filming at nighttime (10 pm - 6 pm or other protection periods , a permit from the responsible environmental offices is required.

general filming permit

The general filming permit is the prerequisite for all other filming permits for filming on public streets.

Important: 

The general filming permit can only be issued for the period for which the insurance company has issued liability insurance cover.  

The general filming permit is issued by the central film office of the Senate Department for the Environment, Transport and Climate Protection, Dept. VI A - Traffic Management, Central Road Traffic Authority (formerly VLB).

Please note: the general filming permit is required to apply for further filming permits. It is valid for up to two years and applies to all of Berlin - excluding motorways.


The following forms must be submitted to the central film office of the Senate Department for the Environment, Transport and Climate Protection, Dept. VI A - Traffic Management, Central Road Traffic Authority (formerly VLB):

Explanation:

The  declaration on the general filming license  is a disclaimer that exempts the State of Berlin from third-party liability claims.

For  confirmation of insurance events (formerly VLB) sign traffic management, Central Road Administration - The insurance company of the Senate has the above-standing ready to download form for the Environment, Transport and Climate Change Division VI A:.. It is not enough to submit a general insurance certificate.

The general filming permit is combined with additional provisions (see below):
Here are a few important points.
  1. In each individual case, filming must be requested in good time, stating the exact location, time and duration, as well as the type of filming intended. The necessary traffic signs and facilities must be entered in a traffic sign plan and submitted with the application.
    The 96-hour deadline must be observed when setting up stopping restrictions.
  2. Filming must not pose a threat to public security or order.
  3. The affected residents must be informed of the location, the time and the progress of the filming by throwing broadcasts no later than 3 days before the filming begins. In addition, a contact person with a telephone number must be named on site.
  4. The general filming permit must be carried and handed over to responsible persons upon request.
  5. Misuse can lead to the revocation of the general filming permit.

Please note:

If the provisions are not met, the police are entitled to postpone the start of the filming until the secondary provisions are met or to stop the filming.

road traffic regulation

The general filming permit is a prerequisite for an arrangement for putting up stopping bans and other measures, such as interval or full closures. If road closures, bans on stopping or other measures (more than usual for traffic) on higher and lower streets are required for filming, this is required. The order is issued by the  Senate Department for the Environment, Transport and Climate Protection, Dept. VI A - Traffic Management, Central Road Traffic Authority (formerly VLB) . This listens to police and district authorities and also includes embassies and, for example, governmental authorities. However, some of this must also be done by the productions prior to submitting the application.


Application forms:

With the explanation traffic sign plan after site inspection, the production company confirms, among other things, that the traffic sign plan to be submitted / submitted is based on a current inspection of  the event or production area and that it corresponds to the actual conditions on site at the start of the filming.


Processing time:

We kindly ask you to submit the application as early as possible, at least 2 weeks  before the start of the measure. In times with a lot of filming, the deadline can also be extended.


Fee:

An administrative fee is charged, which is based on the actual effort of the authority and is specified in the fee schedule for measures in road traffic. The frame fee is between € 10.20 and € 767.00.


Further information:

If the barrier only affects the side walk, a 1.5 meter wide strip must be kept clear for pedestrians to pass through.

special use permit, engineering office


Permission from the owner is generally required for uses of the street country that are related to filming. The civil engineering department of the district offices is responsible for this. The special use is independent of road traffic law and is based on road law.

Fees:

The costs for the fees for the special use of public street land for film work depend on the scope and duration of use and are determined in accordance with the Special Use Fee Ordinance.


The permit is linked to additional provisions:
  1. Driving on the sidewalks or installing the motor vehicles must always take place in such a way that the safety and order of public transport is guaranteed at all times.
  2. The special user is fully liable for all damage to the road pavement and for all accidents caused by driving on the vehicles.
  3. House and shop entrances as well as property entrances must remain accessible at all times so that rescue, fire protection and security measures are not obstructed.
  4. The street green (trees, bushes, lawn, etc.) must be protected from damage. A paved pavement area at least 1.50 m wide must be left between the vehicle and these systems.
  5. Regardless of one's own fault, the licensee is liable to Berlin for all damage that Berlin incurs in connection with the special use of the public special use license. In case of doubt, any damage incurred is considered to have been caused by the licensee.
  6. If third parties raise claims against Berlin in connection with the special use of the public special use license, the license holder must release Berlin upon request and take over the representation of Berlin in a legal dispute.

Note:

A special use of the street in the country without a special use permit, as well as violations of the conditions, meets the requirements of an administrative offense, which can be punished with a fine of up to € 10,000.

regulations for Brandenburg


In contrast to Berlin, the state of Brandenburg does not require a general filming permit.

special road use permit

The required street legal special use permit according to  §46 (1) StVO is  given by the responsible lower road traffic authority of the respective district, the city or the large city of the filming location.

The application must be made at least 14 days before filming begins.


fee

An administrative fee is charged, which is based on the actual effort of the authority and is specified in the fee schedule for measures in road traffic.

The arrangement is associated with  secondary  provisions:

  1. The location is to be kept clear with no signs of stopping and the necessary additional signs and to be set up at least 96 hours before it begins to take effect. The time limit and the length of the prohibited section are to be limited to the absolutely necessary minimum.
  2. Contradictory signage must be covered.
  3. The sign must be removed immediately after completion.
  4. Technology must not be stored in the street.
  5. Coordination with other uses in the area is necessary and residents must be informed of the measure at least three days in advance.
  6. Contamination of the street country due to the filming must be removed immediately.
  7. For work after 7:00 p.m., the requirements of the environmental department must be observed.
